Right to Information in India

The Right to Information (RTI) is an important tool for promoting transparency, accountability, and informed participation in democracy. In India, the right is governed primarily by the Right to Information Act, 2005, which provides citizens with a practical mechanism to obtain information held by public authorities.

What Is the Right to Information?

The RTI Act allows eligible citizens to seek information that is held by or under the control of public authorities, subject to the exemptions and limitations provided by the law.

The purpose of the Act is to promote transparency and accountability in the working of public authorities.

Information may include records, documents, orders, reports, contracts, files, data, and other material covered by the statutory definition.

Who Can Use RTI?

The RTI Act provides the right to information to Indian citizens. A person can submit an RTI application to the appropriate Public Information Officer (PIO) of the relevant public authority.

RTI is generally intended to obtain existing information or records. It should not be used as a substitute for a complaint, appeal, or demand that an authority create a new explanation or opinion.

What Information Can Be Requested?

Depending on the circumstances, a citizen may seek information such as:

  • Government orders and notifications

  • Official records and documents

  • Status of a particular application

  • Details of government schemes

  • Expenditure and utilisation of public funds

  • Copies of relevant reports

  • Rules, policies, and procedures

  • Records relating to public projects

  • Information concerning decisions made by a public authority

The exact availability of information depends on the RTI Act and its exemptions.

What Information May Be Exempt?

The RTI Act does not provide an unrestricted right to every piece of information held by the government. Section 8 contains exemptions covering specified categories of information, including certain matters relating to national security, privacy, confidential information, investigation, commercial interests, and other protected interests.

Section 24 also provides special provisions concerning certain intelligence and security organisations, subject to the exceptions specified in the Act.

Therefore, a request may lawfully be denied where an applicable exemption applies.

How to File an RTI Application

Step 1: Identify the Public Authority

First determine which government department or public authority is likely to hold the information.

Step 2: Identify the PIO

Submit the application to the appropriate Public Information Officer (PIO) or through the mechanism prescribed by the relevant authority.

Step 3: Write Clear Questions

Ask for specific information or records. Avoid unnecessarily broad or vague questions.

For example:

“Please provide a certified copy of the order dated ___ concerning ___.”

This is generally more useful than asking:

“Why has the department not taken action?”

Step 4: Submit the Application

For Central Government public authorities, citizens can use the official RTI Online portal to submit RTI requests and first appeals.

Important: The Central Government RTI Online portal states that applications for State Government public authorities, including the Government of NCT Delhi, should not be filed through that portal. State-specific procedures should be used instead.

What If You Do Not Receive a Proper Response?

If an applicant does not receive the information within the applicable period, or is dissatisfied with the response, the RTI Act provides an appeal mechanism.

First Appeal

A first appeal can be submitted to the designated First Appellate Authority according to the procedure prescribed under the Act.

Second Appeal

Where appropriate, a second appeal may be made to the Central Information Commission (CIC) or the relevant State Information Commission.

The RTI framework establishes both Central and State Information Commissions and provides powers concerning appeals and penalties.

The Central Government’s RTI Online system also provides facilities for submitting first appeals and tracking applications.

What Are the Benefits of RTI?

RTI can help citizens:

  • Understand government decisions

  • Monitor public expenditure

  • Check the status of official matters

  • Obtain copies of government records

  • Promote transparency

  • Improve accountability

  • Identify delays or administrative irregularities

  • Participate more effectively in democratic governance

Important Precautions While Filing RTI

  • Address the application to the correct public authority.

  • Ask for specific existing information or records.

  • Keep a copy of your application.

  • Keep proof of submission and payment.

  • Record the application number and date.

  • Keep copies of responses received.

  • Observe the applicable appeal deadlines.

  • Do not provide unnecessary personal information.

  • Avoid threatening or abusive language.

  • Do not use RTI to harass officials or submit knowingly false claims.

  • Protect confidential personal information when requesting records involving third parties.

RTI and Transparency

The RTI Act recognises that transparency and an informed citizenry are important to democracy. At the same time, the law balances access to information against legitimate interests such as national security, privacy, confidentiality, and efficient government functioning.

The Right to Information Act, 2005 enables Indian citizens to seek information held by public authorities, subject to statutory exemptions. A well-drafted RTI application should be clear, specific, factual, and directed to the authority that holds the relevant information.
